Substance Abuse Policy
At Luxspo Services, we are committed to maintaining a safe, healthy, and drug-free work environment for all employees, contractors, and clients.
Luxspo Services enforces a strict zero-tolerance policy regarding substance abuse. The unlawful manufacture, distribution, dispensing, possession, or use of alcohol, controlled substances, narcotics, or any intoxicants is strictly prohibited — whether on company property or while representing Luxspo Services off-site. Any violation of this policy may result in disciplinary actions, including immediate termination of employment or contract.
Testing and Compliance
1. Consent to Testing
To support our commitment to safety, LuxSpoServices may conduct testing (urine, blood, saliva, etc.) to detect drugs, alcohol, or intoxicants. All contractors and employees must consent to such testing. Refusal to comply may result in contract termination or dismissal.
2. Pre-Contract Testing
All prospective contractors are required to undergo a substance abuse test after a contract offer is made. Candidates who test positive will be disqualified but may reapply after 180 days.
3. Reasonable Suspicion & Post-Accident Testing
Testing may be required if there is reasonable suspicion that someone is under the influence or has violated this policy. In the event of a workplace accident, testing will be conducted within 24 hours, especially if the contractor’s actions may have contributed to the incident. Serious injuries may result in a review of hospital records to determine intoxication.
4. Periodic & Random Testing
Personnel involved in operating commercial vehicles or handling hazardous materials may be subject to random or periodic drug testing with no prior notice.
5. Client-Mandated Testing
Some clients may require drug-free certification. LuxSpoServices will honor such requests and conduct appropriate testing for contractors assigned to those accounts.
Positive Tests & Refusals
A positive test result or refusal to take a test will result in immediate termination of any contract or employment agreement with Luxspo Services.
Off-Duty Conduct
While we do not monitor off-duty behavior, any off-premises substance abuse that affects work performance, safety, or the company’s reputation may lead to disciplinary action.
Seeking Help
We understand that substance abuse is a health issue. Contractors or employees struggling with substance use are encouraged to seek help before any testing is scheduled. LuxSpoServices supports recovery and values proactive action.
Use of Legal Drugs
Contractors or employees using legal medications that could affect performance must provide documentation from a physician confirming they are fit to safely carry out assigned duties.
Legal Compliance
LuxSpoServices adheres to all applicable local, state, and federal regulations, including Department of Transportation (DOT) guidelines.
Suspension During Investigation
In some cases, LuxSpoServices may suspend a contractor or employee without pay while awaiting test results. If the results are negative, full compensation for the suspension period will be provided.
